However, there is no reason to be upset! Our company respects your rights. Below, we have included information that will allow you to quickly and conveniently make a complaint or return the goods in withdrawal.
1. INFORMATION ABOUT EXERCISING YOUR RIGHT OF WITHDRAWAL
In accordance with current legislation, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period shall expire after 14 days from the day on which you acquire possession of the goods or on which a third party other than the carrier and indicated by you acquires possession of the goods.
To exercise your right of withdrawal, you must inform us (Nails Imagination Anna Sikora, ul. Cieszyńska 14, 44-335 Jastrzębie-Zdrój, email: firstname.lastname@example.org) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).
You may use the model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without delay and in any event not later than 14 days from the day on which we are informed about your decision to exercise your right of withdrawal from this contract. We will reimburse you using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise, in which case you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we receive the item or until you provide us with proof of return, whichever event occurs first.
Please send back or hand over the item to us without delay and in any event not later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the item before the period of 14 days has expired.
You will have to bear the direct costs of returning the item.
You shall only be liable for any diminished value of the goods resulting from the use of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
2. INFORMATION ON THE DECLARATION OF THE EXERCISE OF WARRANTY BY THE CONSUMER (COMPLAINTS)
In accordance with current legislation, we are liable to you under the terms of the Civil Code for physical and legal defects.
Upon discovering a defect, you have the right to:
a. make a statement requesting a price reduction;
b. withdraw from the contract, but not if the defect is insignificant;
c. demand to replace the item with a defect-free item;
d. demand removal of the defect.
We will respond to your statement or request within 14 days.
You are obliged to deliver the defective item at our expense to the address (Nails Imagination Anna Sikora, ul. Cieszyńska 14, 44-335 Jastrzębie-Zdrój) and if delivery of the item by you would be excessively difficult (e.g. due to the nature of the item or the way it is installed) you are obliged to make the item available to us at the place where it is located.
We shall bear the costs of replacement or repair, except if the defective item has been installed. In this case, you are obliged to bear part of the costs incurred in excess of the price of the goods. Alternatively, you may require us to pay a proportion of the costs of disassembly and reassembly, but only up to the price of the item sold.
We shall be liable if a physical defect is established within two years of the item being delivered to you or, in the case of a second-hand item, within one year of delivery. Your entitlement is limited to one year from the date the defect is established, but not before two years have elapsed since the item was handed over to you or, if the item was sold second-hand, not before one year has elapsed since the item was handed over to you. An exception to this shall be if the expiry date specified by us or the manufacturer expires more than two years after the item was handed over to you. In this case, we shall be liable under warranty for any physical defects of the goods detected before the expiry of this period.
Liability for legal defects is in essence the same, with the time limit running from the moment you become aware of the defect and the limitation periods running from the time the ruling on the item affected by the legal defect becomes final.
The issue of warranty is extremely complex and we encourage you to read the Civil Code and the websites of the OCCP and consumer organisations describing your rights in detail and illustrating them.
